Welcome to EarthSpoke Farms. These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (collectively, the “Services”). By visiting our site or purchasing from us, you agree to these Terms and to our Privacy Policy.

EarthSpoke Farms is a family-owned farm business based in California. Our online store is powered by Shopify, which provides the e-commerce platform that allows us to sell our products to you.

If you do not agree with these Terms, please do not use our Services.

Eligibility & Use of the Site

By using this website, you represent that you are at least the age of majority in your state or province of residence and that you have the legal capacity to enter into this agreement.

Products & Descriptions

We make every effort to describe our products as accurately as possible, including dahlia cultivars, colors, and characteristics. However:

Variations may occur due to growing conditions, soil, climate, and screen display differences
Product descriptions, availability, and pricing are subject to change without notice
We reserve the right to limit quantities or discontinue products at any time

Dahlia tubers and other agricultural products are living materials and may appear dormant upon arrival.

Orders & Payment

Placing an order constitutes an offer to purchase. Orders are not accepted until payment is processed and confirmed.

We reserve the right to:

Refuse or cancel any order
Limit purchases per customer, household, or order
Cancel orders due to inventory issues, errors, or suspected misuse

All prices are listed in U.S. dollars and do not include taxes or shipping unless stated otherwise.

Shipping & Delivery

Shipping terms, timing, and rates are detailed in our Shipping Policy, which is incorporated into these Terms by reference.

Delivery dates are estimates only. Once an order has been transferred to the shipping carrier, risk of loss passes to the customer.

Returns, Refunds & Guarantees

Returns, refunds, replacements, and guarantees are governed by our Return & Refund Policy and our EarthSpoke Guarantee, which are incorporated into these Terms by reference.

Because many of our products are live or seasonal agricultural items, returns are limited and handled on a case-by-case basis.

Farm Visits & Agritourism (If Applicable)

EarthSpoke Farms may offer on-site activities such as U-Pick events, farmstand visits, or other agritourism experiences.

Participation in on-farm activities involves inherent risks associated with outdoor, agricultural environments. Visitors assume responsibility for their own safety and agree to follow posted rules and staff instructions.

Intellectual Property

All content on this site—including text, images, product descriptions, logos, graphics, and design—is the property of EarthSpoke Farms or its licensors and is protected by intellectual property laws.

You may use the site for personal, non-commercial purposes only. No content may be copied, reproduced, or distributed without prior written permission.

Feedback & Reviews

If you submit reviews, feedback, photos, or other content, you grant EarthSpoke Farms a non-exclusive, royalty-free, worldwide license to use that content for business and marketing purposes.

Our store is hosted on Shopify. While Shopify provides the platform, all purchases are made directly with EarthSpoke Farms.

Our Services and products are provided “as is” and “as available,” except as expressly stated in our EarthSpoke Guarantee.
